This is the Privacy Policy of EchoLive ("EchoLive", "we", "us" or "our"), which is incorporated into and subject to our Terms of Use. Please read on to learn more about our data processing practices. By accessing or using our EchoLive mobile application ("App") or all services offered therein or related thereto (collectively referred to in this Privacy Policy as the "Services"), you agree to the terms of this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use the Services.
When you visit the App, we may collect data from you as described below. When you register and use an account with us, we will collect data from you to provide the Services. The type of data we collect depends on how you use our App and Services.
When you visit and use our Sites or Apps, install Apps on your device, or register an account with EchoLive, we collect some personally identifiable information about you so that we can provide you with the Services. More details about this are described below.
2.1. “Registration and Account Data”
When you install the Services on your device and/or register an account with EchoLive, personal and/or non-personally identifiable information may be collected from you. There are two types of Registration and Account Data: Data: - This is important to help us provide you with the Connect and Friends features in the Services.
Information You Provide (Optional) - You may also choose to provide additional personally identifiable information, such as a photo of yourself or an account nickname, gender, birthday, your country, and information about your interests. For example, you may indicate your interests in your profile page. Providing such information is completely optional. If you register and log in using an Apple account, we may also collect other information that you provide to us. We will store this information on our servers and use it to facilitate your use of the Services . For example , we may synchronize your EchoLive account between different devices you use to access our Services.
We may also use your contact information to market to you, where permitted by the laws of your country - for example, if there are new products or updates about changes to our Services, and to help others find your account, if permitted by your settings.
In addition to the video calling feature, you can also use our personal text messaging service as part of the Services in the App. When you communicate with others by sending or receiving text messages, we will store and process your communications and information related to them. This includes scanning for malicious content, detecting abusive and prohibited images, and using reported issues. We also use information about who you communicate with and when (but not the content of those communications) to better understand the use of our Services and to protect the security and integrity of our platform.
2.2. Log Data
When you view content or otherwise interact with our Services, we receive information, which we call "Log Data".
For example, we may receive information about you when you visit our websites, log in to our Services, interact with our email notifications, authenticate with third-party services using your account. This Log Data includes configuration information provided by your EchoLive application or desktop browser, referring web pages, pages visited, your mobile carrier, device information (including device and application IDs), search terms (including search terms not submitted as queries). We also receive Log Data when you click, view or interact with a link or establish a connection on our Services, as well as general information about your communications on EchoLive, such as the users with whom you communicated and the dates and durations of your communications (but not the content of such communications, except as required for safety and security reasons), including when and whether you install another application through our Services. We use Log Data to operate our Services and to ensure their safe, secure, and robust performance. Log Data is used to protect account security, determine what content on our Services is popular, and, more importantly, to connect you with new and old contacts on EchoLive. We also use this data to improve our Services and to improve our own marketing efforts. We also use metadata, which is information about items you provide through EchoLive.
2.3. Other Third Parties and Affiliates
We may receive information about you from third parties such as partners who help us evaluate the safety and quality of content on our platform, our corporate affiliates, and other services you link to your account.
We use the information we receive to operate our Services. For integrations that we formally support, you may revoke this permission at any time from your application settings; for other integrations, please visit the other service you have connected.
2.4. During Use of the App
Device Information - EchoLive may collect and store information about the device you use to install and access the App, such as your device model, unique device identifiers, IP address, device capabilities, and page view statistics.
Your Activity - EchoLive may collect and store information about your and others' use and activity of the App and our Website, including matches, number of matches made by member, length of matches, SMS messages, music selected using the App messaging service, and number of uses by region. We need access to your device to use and copy your photo as your profile picture and any photo/media files you choose to share so that they can be copied within the App and our Website. We need to be able to access your camera/microphone and record video/audio so that we can provide video and audio, including music files and related files, for your use and enjoyment of the Services when using the App and our Website, and to help us meet compliance requirements, such as ensuring that no one under the age of 18 uses our App or our Website.
Content You Share - EchoLive allows you to share your in-App profile, interests, text messages, photos, screenshots, videos, music, and other communications with other users, and if you choose to do so, your in-App profile, interests, text messages, photos, screenshots, videos, music selections, and other communications will be stored on our servers. In addition, if you choose to share these items with other EchoLive users, we may not be able to delete them from our servers or make them inaccessible to anyone with whom you have shared them. By choosing to share such information, you agree that you may no longer be able to control how that information is used and that it may become public (depending in part on your actions or the actions of other users with whom you share information). EchoLive is not responsible for any use or misuse of such information you share with other users. You can refer to Section 6 below for more information about the parties with whom you may choose to share your content.
Content You Create - We may also collect and store any user content (such as photos, screenshots, comments, interests, and other materials) that you create or post on the App ("User Content").
Error Report Information - If the App crashes or does not function properly, we also collect error report information so that we can investigate the error and improve the stability of the App for future releases. Generally, these reports do not contain personally identifiable information or contain only incidental information. These error reports contain information such as device type and version, device identifier, when the error occurred, the features being used, and the state of the App when the error occurred. We do not use this information for any purpose other than investigating and fixing the error.
2.5. When you visit our Platform
We may use online tracking technologies, such as pixel tags, web beacons, and other similar technologies, to automatically collect the following information:
· The number of times you visit our Platform, such as your browsing history, how long you stay on our Platform, and how often you visit; and
· Information provided by your mobile or other device when you interact with our Platform, including your IP address; and the device you use to browse our Platform (e.g., your device ID, operating system, device type, mobile application crashes, and other system activity).
You have the right to disable any of these online tracking technologies. These technologies help us ensure that you are able to log into your account securely, develop our Services by using data analytics, and develop new services for our users.
2.6. Age
The Services are not directed to children or persons under the age of eighteen (18), and we do not knowingly collect personally identifiable information from children or persons under the age of eighteen (18) on the Services. However, we do collect information about your age to ensure that underage users are not part of our Platform, to maintain the security of our Services, and to use third parties to help us maintain the correct age profile for our applications. If we become aware that we have inadvertently received or collected personally identifiable information from users under the age of eighteen (18) on the Service, we will delete such information from our records. If you are under the age of eighteen (18), please do not use the Service.
You can access, control and modify the user profile information you provide on the App (your "Profile") at any time. This includes your profile and profile pictures and videos, user nickname, bio, the languages you speak and your birthday, all of which can be shared with your EchoLive contacts. Therefore, please make sure you only share what you want to include in your profile. Your Profile will be available to other App users with whom you are connected. In addition, your Profile may be discovered by other App users, for example, through the App's Contacts list in the App, which includes your close connections with other users.
You may also choose to "block" any other EchoLive user in your Contacts list in the App, which will prevent them from discovering your Profile at any time.
We apply the principle of data minimization when collecting and using your data and ensure that your data is only used for the purposes described below. We will only process your data in connection with the Services and other relevant business purposes, including:
4.1 To provide you with the Services, including:
· Connecting you with other users within the App;
· Enabling you to share your profile with other users on the App;
· Providing you with the video and audio calling features of the App;
· Allowing you to send images and videos through the App;
· Showing you the nicknames of people you are communicating with and showing your nickname to people you are communicating with on the App; and
· Providing you with certain features of the App that may be offered from time to time, such as our Premium Services (see our Terms of Use), playing games, and sharing/playing music during video calls.
· Enabling you to contact us
· Connecting with third parties for payment processing
· Running analytics to provide you with better and more relevant connections, provide you with more offers, and provide you with updates on our Services.
4.2 Help us manage and maintain your account and user profile on the App, including:
· Create and update your account;
· And provide you with any administrative notices, alerts and communications related to your use of the App.
· We use the information we hold to develop, test and improve our Services, including conducting surveys, compiling research, statistics and analysis and the habits and behavior of our users, such as transaction history, online interactions, and testing and troubleshooting new products and features.
· Process and process any payments for transactions conducted through the Services through third-party providers.
· We use the information we hold to send you marketing information and notifications; and to communicate with you about our Services and let you know about our policies and terms.
· We also use your information to respond to you when you contact us.
4.3 Promote safety, integrity and security.
· For audit, compliance, controls, security and other risk management purposes we use the information we have to verify accounts and activity, combat harmful conduct, detect and prevent other bad experiences, illegal behavior, maintain the integrity of our Services, and promote safety and security. For example, we use a combination of automated detection technology and manual review of the data we have to investigate suspicious activity or violations of our Terms of Use and policies such as this Privacy Policy and enable you to report and contact us if you have any issues to raise.
4.4 For business administration purposes, including data and records management:
· To establish, exercise and/or defend our legal rights.
· To comply with our legal, regulatory and reporting requirements to regulators.
· To ensure user safety through content moderation.
· In connection with a corporate transaction involving EchoLive, such as the purchase or sale of a business division, acquisition, merger, sale of assets or other similar event.
· To enable us to provide the Services to you and our contractual commitments.
4.5 Information in our Services:
· We connect information about you and your activities on EchoLive with other apps and services we offer in order to provide you with a broad range of engaging experiences.
There are different legal reasons for processing your data while you are using our Service. With respect to these legal reasons, we process your data for one or more of the following basis.
· As is necessary to fulfill our contract (Terms of Use with you)
· Legitimate Interests. Where the processing is necessary for legitimate interests pursued by us or by a third party for example for the prevention of fraud, network and information security, internal administrative purposes, except where such interests are overridden by your interests or fundamental rights and freedoms which require protection of personal information.
· Your Consent. Where you have given us consent to process your personal information for specified purposes, such as to provide our Service and other items requested by you.
· Comply with the Law. Where the processing is necessary for compliance with a legal obligation or requirement.
· As is necessary in the public interest and to protect your vital interests or those of others.
Any information or content that you voluntarily disclose or post on the App (such as your User Content) will be available to the public. Once you share or make such User Content public, it may be viewed and re-shared by others, and once public, it may not be possible to prevent the distribution of that content.
Even if you delete any User Content you create or post on the App (e.g., screenshots, etc.), copies of such User Content may remain accessible in cached and archived pages of the App, or other users or third parties may have copied or saved such information.
Any personally identifiable information that you (i) share with other users on or through the App in text messages, photos, videos or otherwise; or (ii) submit through live messaging on the App may be viewed and used by others. EchoLive is not responsible for any use or misuse of such information you share or submit.
If you choose to receive direct marketing from us via notifications, you agree that we can use your personally identifiable information to:
· Send you direct marketing, such as direct marketing about gold coin products, and the latest news, events, updates, offers, competitions and promotions related to our services;
We will always ask for your consent before providing you with direct marketing. You can opt out of receiving such direct marketing from us at any time. Please see the section below on your data protection rights.
You can always control what information you choose to share with us on the App (except for information which we have indicated as mandatory for you to provide). To do so, you can change your settings in the App or in your mobile device. Alternatively, you can remove the App from your mobile device entirely.
You can choose to remove your data anytime you want. If you ask us to delete your account, we will use commercially reasonable efforts to remove your data from our servers, subject to any applicable legal or other requirement to maintain certain records of your personally identifiable data. Please note that the deletion of your personally identifiable data from our database may result in us not being able to provide you with the Service.
If you visit a website or application provided by a third party, including through the Application or Website, that third party may also collect information about you. We do not own or control, and are not responsible for, the privacy practices of third-party websites or applications. Please refer to each third party's privacy policy for more information about how they collect and use the information they collect about you. This Privacy Policy does not apply to any exchange of information between you and any such third party.
Protecting your privacy and personal information is a top priority for EchoLive. We protect the privacy and security of all personally identifiable information you provide to us. We stress test our systems to help us improve. Access to all personally identifiable information is limited to the EchoLive team and third-party partners and service providers who need to know the information to provide, operate, develop, maintain, support or improve the Services or otherwise carry out any of the purposes set forth in this Privacy Policy. EchoLive implements appropriate technical and physical security measures, such as the use of password protection, access logs, and system monitoring, to maintain the confidentiality and security of all user information and to prevent any loss or unauthorized disclosure, use and modification.
However, due to the inherent nature of the Internet and related technologies, we cannot guarantee the protection of the information under our control against any loss, misuse or alteration.
Your information may be stored and processed in any country in which EchoLive or its service providers maintain facilities. EchoLive reserves the right to transfer information outside of your country in this regard, or for the purposes of sharing or disclosing data as described in this Privacy Policy. By using the Services, you consent to the transfer of information outside of your country. We will also process information about you for these purposes as permitted by applicable law and its terms and policies.
When we transfer personal information internationally, we implement safeguards in accordance with applicable law. If you would like more information about our personal data transfer practices, please contact us at the contact information listed in the Contact Information section.
We will keep your personal data only for so long as is necessary to fulfill the purposes outlined in this Privacy Policy, unless the law requires us to keep it for a longer period. Once we no longer need your personal data, we will either irreversibly anonymize or securely delete it from our servers.
EchoLive would like to make sure you are fully aware of all of your data protection rights. In particular, you are entitled to the following rights:
· Right of Access:
You shall have the right to obtain from EchoLive confirmation as to whether or not your personal information is being processed, and, where that is the case, you may request for a copy of your personal information.
· Right to Withdraw Consent:
The provision of your consent shall give EchoLive a lawful basis to process your personal information. You may also revoke your consent to processing.
· Right to Rectification:
If you entered the incorrect age or gender, we can assist you. Please submit a feedback within app and we will handle your request.
· Right to Erasure:
You shall have the right to ask for your personal information to be deleted in certain circumstances;
Please note that your right to erasure may be limited if the data are necessary for compliance with a legal obligation or for the establishment, exercise or defense of legal claims.
· Right to Restriction on Processing:
You shall have the right to object to and ask for restrictions on the processing of your personal information in certain circumstances;
· Right to Data Portability:
You shall have the right to receive the personal information you have provided to EchoLive, in a structured, commonly used and machine-readable format and have the right to transmit those personal information from EchoLive to another controller without hindrance from EchoLive to which the personal information have been provided, where:
· the processing is based on your consent; and
· the processing is carried out by automated means;
· Right to Objection:
You shall have the right to object, on grounds relating to your particular situation, at any time to processing of your personal information.
EchoLive shall no longer process the personal information unless EchoLive demonstrates compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defense of legal claims;
· Right to Complaint
You shall have the right to file a complaint with our Data Protection Officer if you think that one or more of your rights have been infringed by EchoLive.

We reserve the right to change this Privacy Policy at any time. You can review updates to our Privacy Policy at any time through the link on our Platform. You consent to receive electronic communications and/or posting of revised Privacy Policy on the Platform, and you agree that such electronic communications or postings constitute notice of the Privacy Policy to you.
If we make material changes to this Privacy Policy, we will notify you by posting the revised Privacy Policy or through a notice on our Platform, or as a pop-up in our application, or as required by law. You agree to review the Privacy Policy periodically to be aware of any modifications. You agree that your continued use of the Services after we post a revised Privacy Policy or provide notice on our Platform constitutes your acceptance of the revised Privacy Policy.
